All prices are listed in South African Rand (ZAR) and are inclusive of Value Added Tax (VAT) at the current rate, unless otherwise stated. Prices are subject to change without notice. Despite our best efforts, pricing errors may occasionally occur. If a pricing error is discovered, we reserve the right to cancel any orders placed at the incorrect price.

All Products are subject to availability. We reserve the right to limit the quantity of Products ordered, discontinue any Product at any time, or refuse to accept any order. In the event that a Product is unavailable after an order is placed, we will notify you and offer a refund or alternative.

5. Ordering and Payment

5.1 Placing an Order

To place an Order through our Site, you must:

• Agree to pay for the Products ordered

By placing an Order, you make an offer to purchase the Products. We reserve the right to accept or reject any Order for any reason.

Delivery times are estimates and not guaranteed. While we strive to deliver within the stated timeframes, delays may occur due to factors beyond our control, including but not limited to:

• Courier delays
• Public holidays
• Weather conditions
• Customs clearance (for international orders)

6.3 Delivery Charges

Shipping charges are calculated at checkout based on the delivery location, weight, and size of the Products. Any applicable customs duties or import taxes for international deliveries are the responsibility of the Customer.

6.4 Risk of Loss

Risk of loss and title for Products pass to you upon delivery. You are responsible for inspecting the package upon receipt and reporting any damage or missing items to the courier and to us within 48 hours.

Our total liability to you for any claims arising out of these Terms or your use of our Site shall not exceed the total amount paid by you for the Products in the twelve (12) months preceding the claim.

If the dispute cannot be resolved through negotiation, it shall be submitted to mediation or arbitration in accordance with the rules of the Arbitration Foundation of Southern Africa (AFSA). The arbitration shall take place in Johannesburg, South Africa, and shall be conducted in English.

15. Force Majeure

We shall not be liable for any delay or failure to perform our obligations under these Terms if such delay or failure is caused by events beyond our reasonable control, including but not limited to:

• Natural disasters (floods, earthquakes, fires)
• War, terrorism, or civil unrest
• Government actions or regulations
• Labor strikes
• Power outages or network failures
• Supplier or courier disruptions

16. Severability

If any provision of these Terms is found to be invalid, illegal, or unenforceable by a court of competent jurisdiction, the remaining provisions shall continue in full force and effect, and the invalid provision shall be deemed modified to the minimum extent necessary to make it enforceable.

17. Entire Agreement

These Terms, together with our Privacy Policy and Refund Policy, constitute the entire agreement between you and Mega Source regarding your use of our Site and services, and supersede all prior or contemporaneous communications and proposals, whether oral or written.

21. Consumer Protection Act (CPA) Notice

This Agreement is subject to the provisions of the Consumer Protection Act 68 of 2008 ("CPA"). Where required by the CPA, any provision of these Terms shall be interpreted in a manner that is consistent with the CPA and your rights as a consumer. In the event of any inconsistency between these Terms and the CPA, the CPA shall prevail.

21.1 Your Rights Under the CPA

• Right to Return: You may return goods within 30 days of delivery for a refund under certain conditions (see Refund Policy).
• Right to Cancel: You may cancel a fixed-term agreement at any time with notice.
• Right to Quality Services: You have the right to receive goods that are of good quality, in good working order, and free from defects.
• Right to Disclosure: You have the right to receive all information in plain and understandable language.

22. Warranty Disclaimer for Specific Product Categories

22.1 Generators

Generators are sold with the manufacturer's warranty. We do not cover damages resulting from improper use, lack of maintenance, fuel contamination, or unauthorized modifications. Always follow the manufacturer's guidelines for operation and maintenance.

22.2 Bicycles

Bicycles are tested for quality, but wear and tear from normal use is not covered under warranty. Assembly should be performed by a qualified professional to ensure safety.

22.4 Light Towers

Light towers are heavy equipment requiring proper installation and operation. We recommend professional assembly and regular inspection.

22.5 Gym Equipment

Gym equipment must be assembled correctly and used for its intended purpose. Regular maintenance is required to ensure safety and longevity.
